Elsinore LZ Usage Restrictions

On November 29th of last month, the landowners tried one more time to remove us from the LZ. Their attempt at a Stay was denied. With the guidance of John, joined now with Frank, the E-Team has made great strides to hold our position with the LZ. The Lawyers for the opposition have tried many times, with different avenues, to remove us, only to be rejected by the judge presiding over our case. I actually put my head in my hands listening to Gallagher make a fool of himself in front of the judge last Thursday. We have done well in court. We have been prepared and on the side of the law, each time. This is why we win each battle.

However, we have a problem within ourselves to lose this case. This problem is called "Contempt of Court". The dictionary puts it in a term we all can understand;

"Contempt", 3). Open disrespect or willful disobedience of the authority of a court of law or a legislative body.

You only need to watch TV to see what happens to all these stars who are on probation and openly disobey a court order. They end up behind bars, or paying fines, or both. Mind you, they have millions of dollars to spend on lawyers and lobbyists to help them out. We don't. Part of our allure to the judge is we come off as the good guys. You can see it in his demeanor and through his actions that have got us where we are today. Good guys don't openly disobey a court order. That's what the bad guys do.

All of you have spent money on your memberships, whether it be in the USHGA, the EHGA or both. You all have donated to the cause, some of you more than others, but just by being a member, you have helped immensely. It is imperative, we all continue to be vigilant with ourselves, our drivers, and visitors. By not following the Judge’s Orders of the Preliminary Injunction, we run the risk of losing everything we have worker so hard for.

Please re-read the Preliminary Injunction (attached) and adhere to it verbatim. Follow all the rules stated in the document. Don't try to read something into it that isn't there.

Pay special attention to page 3, line 5, paragraph f; "Their presence on the property shall be solely for the purpose of assisting the pilot in exiting the property, following such pilot's landing as part of the pilot's participation in the sport". Page 4 line 12 paragraph J; "No person shall be allowed to enter or land upon the property unless such person has been listed in the booklet, to be supplied by plaintiff, with all of the required information and such person has otherwise complied with the terms of this Preliminary Injunction."

If someone asks for your information, give it to them politely. If you don't have the proper paper work and you're in the LZ, you have ruined thousands of hours of hard work by people who have kept you flying (and landing) at Elsinore. We aren't asking you to help us as much as we're asking you to help yourselves hold on to what all of you have worked long and hard to do, keep an LZ in Elsinore for years to come.

Don't party in the LZ. Don't be the one who gets subpoenaed, then has their name called in court to sit in front of your friends and the judge, only to answer some very difficult questions as to why you were the one that caused the EHGA to be in Contempt of Court.

(At present, we expect them to actively try to find us in Contempt of Court. Electronic surveillance is not out of the question. They could be there, even if you do not see them.)

I turned in all of my paperwork, was informed I am good to fly, and to use my USHPA number as my EHGA number. Is there paper work I am supposed to have in my possession when we fly? I don't want to jeopardize the sight.

EHGA doesn't issue cards. You should have gotten an e-mail saying you were on the list after your paperwork went in. If you submitted your paperwork and did not get confirmation, contact Bill Soderquist. His contact information is on the EHGA Membership form http://www.theeteam.org/membership.htm (download the form).

BTW, E-Team memberships expire Dec 30 so it's a good time to send them a check.

Yes, I have completed the proper paperwork and been informed via email I am good to fly.

But, after reading the initial post, it leads me to believe I have to carry docummentation on my person when I land.

Am I correct that all I need to land, is ID and USHPA Number/Card to be incompliance, no additional documentation on my person required? Yes/No

Do everything listed in the Landing Requirements Document

Once the above listed is completed and you have been notified by Bill that he has sent your Waiver etc (Do everything listed in the Landing Requirements Document) The only requirement that you would need to do at the OAK tree LZ is < Upon reasonable request by land owner or representative > Is say your name and, if applicable, EHGA membership number (same as your USHPA #). What I do is say my name and show them my USHPA card, I can’t remember the #. In the past the representative would write my name and # down to check with the paper work EHGA (Bill) has submitted. If ask tell them your name and USHPA # or show your USHPA card, nothing more. You do not have to show them anything, no card etc. Only state your name and EHGA # same as your USHPA #
